1. Introduction and Acceptance of Terms
Company Information
These Terms & Conditions (“Terms”) govern the relationship between you (“Client” or “you”) and Just Right Solutions LLC (“the Company,” “we,” “us,” or “our”), a limited liability company located at 72 Beverly Drive, Albertson, NY 11507. Our website is https://boliviaoverlandtours.com (“the Site”).
Acceptance of Terms
By accessing the Site, using our services, or making a booking inquiry, you confirm that you have read, understood, and agree to be legally bound by these Terms. If you do not agree with any part of these Terms, you must discontinue your use of the Site and our services.
Role as Intermediary
The Company acts solely as an intermediary on behalf of local Bolivian tour operators or other third-party service providers (“Third-Party Providers”) that organize and operate the tours and travel-related services featured on the Site. When you book or purchase tour services through the Site, you enter a direct contractual relationship with the Third-Party Provider. The Company’s role is limited to facilitating reservations, handling payments on behalf of the Third-Party Provider (where applicable), and providing customer support within the scope of our agreement with the Third-Party Provider.
2. Bookings, Payments, and Modifications
Booking Requests
All bookings requested through our Site are subject to acceptance by both the Company (as the intermediary) and the Third-Party Provider (as the actual service provider). A booking is only confirmed once you receive a written confirmation (e.g., email) from the Third-Party Provider or from us on their behalf.
Pricing and Payment
Tour prices displayed on the Site are based on information provided by the Third-Party Provider and are subject to change until a booking is confirmed. Payment may be collected by the Company on behalf of the Third-Party Provider or directly by the Third-Party Provider, depending on the arrangement. You agree to abide by any additional payment terms, cancellation policies, or other conditions set by the Third-Party Provider, in addition to these Terms.
Changes and Cancellations
Any request to change or cancel a confirmed booking must comply with the applicable Third-Party Provider’s policies. The Company will assist in communicating such requests but makes no guarantee that the Third-Party Provider will accommodate them. The Third-Party Provider has sole discretion over cancellations, refunds, or rescheduling. The Company is not liable for any losses or damages arising from changes or cancellations.
3. Liability Disclaimer and Limitations
Third-Party Provider Liability
The Third-Party Provider (e.g., a local Bolivian tour operator) assumes all liability related to the execution of the tour, including but not limited to safety, quality of service, personal injury, death, or loss of property. Any claims for compensation, refunds, or damages related to the actual performance of the tour must be directed directly to the Third-Party Provider.
Company as Intermediary
The Company’s liability is strictly limited to errors or omissions made by the Company in its capacity as a booking intermediary (e.g., incorrect booking confirmations). The Company shall not be held liable for any act, omission, breach, negligence, or default of any Third-Party Provider or other third party. The Company does not guarantee or warrant the performance or reliability of any Third-Party Provider.
Assumption of Risk
Travel and adventure-related activities carry inherent risks. By making a booking, you acknowledge and accept these risks. The Company shall not be liable for any losses, injuries, or damages sustained while participating in activities arranged by the Third-Party Provider.
Force Majeure
Neither the Company nor the Third-Party Provider shall be responsible for any failure to perform due to causes beyond reasonable control, including but not limited to natural disasters, pandemics, government actions, civil unrest, or strikes.
4. Travel Requirements
Passports, Visas, and Health
You are responsible for obtaining valid passports, visas, and any required immunizations or medical documentation. The Company bears no responsibility if you are refused entry, removed from a destination, or incur additional costs due to improper travel documentation or failing to meet health requirements.
Travel Insurance
The Company strongly recommends that you obtain comprehensive travel insurance covering trip cancellations, medical expenses, personal injury, and other contingencies. Any dispute regarding coverage or claims lies solely between you and the insurance provider.
5. Conduct and Behavior
Compliance with Laws
You agree to comply with all local laws, customs, and regulations in any country visited. The Company is not responsible for any legal consequences resulting from your failure to comply.
Right to Exclude
The Third-Party Provider may refuse service or remove you from a tour if your behavior is disruptive, unsafe, or harmful to others. In such cases, no refunds will be provided, and the Company assumes no liability for additional costs incurred.
